Business License

Every person, firm, company or corporation located within the City of Sisters must secure a business license.  All businesses are required to comply with local, state, and federal laws.  Non-profit organizations who engage in business activities are required to secure a license.  To find out if you are within the City limits please call City Hall at (541) 549-6022.

In addition, the following types of businesses are required to purchase a business license:

A door to door solicitor
A non-permanent business who conducts business within the City on a regular basis
Any business that engages in construction activities within the City

Application

An application form for a city business license may be obtained at Sisters City Hall, 520 E. Cascade Avenue or by downloading the application below.  Your completed application with check for payment of license fees can be dropped off at City Hall or mailed to:

Please allow 2 weeks to process your application and issue your license.  A change of business address requires a new business application to be completed.

Renewals

Once you have obtained a license, a renewal notice will be mailed to you before the expiration date. If you do not receive a renewal notice, please contact City Hall at (541) 549-6022. Failure to receive a renewal notice does not relieve the business owner's responsibility of renewing the business license.

License

The City of Sisters business license is effective from July 1 through June 30.  License fees are set by Council resolution.  The fee for a new license is prorated by quarter

All City business license certificates must be posted in a conspicuous place upon the premises of the business.

Business license certificates are not transferable.  Change of ownership requires a new application to be completed.

Enforcement

Violation of any provision of the business license ordinance is subject to a fine not to exceed $100 for each violation.  The City may also file suit for an injunction against the business until the license fee is paid.

Determine and follow local zoning and building codes

Contact the Community Development Department at (541) 323-5207 for zoning, land use, and building code compliance prior to the signing of leases or sales agreements; and, before making any exterior or interior alterations.

After obtaining building permits, you can perform any building modifications required by the City, or those necessary for the successful operation of your business.

Sign regulations

The City of Sisters has a sign ordinance. If you plan to install a new sign, or make changes on a sign that has already been installed, please contact the Community Development Department at (541) 323-5207.

Event Permit

A Public Event is an assembly or gathering of persons for entertainment, recreation, the display or sale of goods or services, or other common purpose on public property.

Application

Applications are taken no earlier than January 1 of the year the event will occur.  Applications for a small event (up to 24 people) must be submitted at least ten (10) days prior to the event.  Applications for large events (25 people and over) must be submitted at least thirty (30) days prior.  Required approvals from outside agencies and departments must also be included.

Fees and deposits are due at the time the application is submitted.

Fuel Tax

Motor Vehicle Fuel Tax

The City of Sisters maintains over 53 lane miles of roads.  The City’s street maintenance and improvement plan will provide a well maintained transportation system and increase the lifespan of the existing street infrastructure.  The City acknowledges the need for a dedicated revenue source to pay for needed improvements and repairs and therefore approved Ordinance No. 388 imposing a local gas tax.

Tax Imposed

The Motor Vehicle Fuel Tax imposes a $.03 per gallon tax on motor vehicle fuel sold, used or distributed in the City by a motor vehicle fuel dealer.

License Requirements

No dealer shall sell, use or distribute any motor vehicle fuel until a dealer's license is secured.
To obtain a City of Sisters Motor Vehicle Fuel Dealer License print the application below and return to City Hall at 520 E. Cascade Avenue or mail to City of Sisters, P.O. Box 39, Sisters, Oregon  97759.

Monthly Statement

Every motor vehicle fuel dealer is required to submit the Fuel Tax Monthly Report Form on or before the 25th day of the month following collection of the fuel tax.  This report shows the number of gallons of motor vehicle fuel sold, distributed or used during the preceding calendar month. Payment of fuel tax collected is submitted with the monthly report.  Fuel dealers are entitled to deduct 5% of tax owed for administrative costs.

Home Business Occupation Permit

A home occupation is a legal, nonresidential income-producing use or activity that is a secondary use of a residence. The purpose of this section is to allow professional and commercial ventures that are appropriate in terms of scale and impact to operate from a dwelling. Home occupations are subject to a Type I review and are subject to the development standards of the underlying land use district. Please contact the Community Development Department.

Liquor License

After a license application has been accepted by the Oregon Liquor Control Commission (OLCC), if your business is located within Sisters city limits, the application must be submitted to the Sisters City Council for a recommendation. Submit the entire completed form to the City Recorder at City Hall so the license can scheduled for review at a regular City Council meeting. Please allow up to three weeks for this process to occur. The City will have the Deschutes County Sheriff run a background check on all parties involved and provide a recommendation back to the city. The Council will then review the application at a regular meeting and make a recommendation to the OLCCC to grant or deny the license. OLCC will take the local government recommendation into consideration before deciding to issue a license. 

The City charges a fee of $25 for the new Liquor license application.

Transient Room Tax

All “hotels” doing business with nightly room rentals within the City of Sisters must possess a City business license and remit room tax on a monthly basis.

A “hotel” is any structure, or any portion of any structure which is occupied or intended or designed for transient occupancy for thirty (30) days or less, for dwelling, lodging, or sleeping purposes, and includes any hotel, inn, tourist home or house, motel, studio hotel, bachelor hotel, lodging house, mobile, manufactured, or modular homes, condominiums, public or private dormitory, fraternity, sorority, public or private club, space in mobile home parks, trailer parks, recreational vehicle parks, or similar structures.

$250,000 is paid annually to the Sisters Area Chamber of Commerce for the promotion of tourism in Sisters.

Tax Imposed

The City’s transient room tax rate is 8.99% of the gross rent charged to customers for overnight lodging.  Gross Rent is defined as all non-optional fees, including cleaning, pet, and crib charges.  Exemptions are made for occupants of more than 30 successive calendar days (monthly rentals), Federal employees on federal business, health care facilities, and homeowners who rent their houses incidentally to their own use.

Monthly Reporting

Operators collect room tax from customers and remit the collected taxes to the City by the 15th of the following month along with the Transient Room Tax report.  An administrative fee of 5% of total taxes collected may be deducted from total taxes due.  Penalties and interest will be charged for taxes not paid when due.

Transient Vendor License

A Transient Merchant is a person who either carries goods, wares or merchandise from area to area (or City to City), selling or offering the same for retail sale; or who offers goods, wares, merchandise or services from a vehicle, trailer or cart, temporary apparatus, temporary location, or door to door without making the business permanent and continuous in the City.

An application form for a Transient Merchant license may be obtained at Sisters City Hall, 520 E. Cascade Avenue or by downloading the application below.  Your completed application with check for payment of license fees can be dropped off at City Hall or mailed to:

Property owner permission is required to obtain a license.  Please allow 10 days to process your application and issue your license.

License

License fees are set by Council resolution.  The license must be displayed during all hours of operation.  Upon receiving four signed written complaints from four separate persons against a transient vendor, the license will be reviewed and may be revoked or suspended.
